  • Disciplinary hearings - School districts have disciplinary guidelines that they follow, and these guidelines will typically identify the appropriate punishments for offenses such as bullying, cheating, destruction of school property, or possession of drugs or other prohibited items. If a school decides to remove a student from the classroom for more than 10 days, the student will be entitled to a disciplinary hearing. We can provide representation at these hearings, advocating for a child to receive an appropriate punishment that will allow them to continue attending school.
  • Special education evaluations and domain meetings - Parents may request an evaluation to determine whether a child with disabilities will require special services or accommodations. We can provide representation in these evaluations, including in domain meetings which address which types of evaluations will be performed.
  • Placement determination - Students with special needs are entitled to receive an education alongside non-disabled students to the maximum extent possible and in the least restrictive environment.   • IEP/504 meetings - Once a school has agreed to an IEP or 504 plan for a child, parents may encounter concerns that these plans are not being followed or that their child is not receiving the appropriate services or accommodations.   • Manifest determination reviews - Special procedures must be followed when disciplining students with disabilities. If a school plans to suspend a student from school or services for more than 10 days, the student is entitled to a manifest determination review. This review will examine the relationship between the student's disability and their behavior, as well as whether the behavior was due to inappropriate services provided to the student. The decisions made during the review will determine whether the student can be removed from the school.
  • Due process hearings and mediation/resolution sessions - A formal administrative hearing may be requested where a school district will be represented by an attorney. In some cases, mediation or another form of dispute resolution may be mandated.
