The Home Sale Process

There are many steps to selling your home, including:

  • Cleaning and repairing your home: Once you have decided it is time to sell your home, it is best to review the house with as objective of an eye as possible. What needs cleaning, repairing, or updating? While you probably do not want to undertake extensive renovations before a move, you may need to give the house a bit of TLC.
  • Valuing your home: Before you can put your home on the market, you need to determine its value. You can do this by looking at what other similar homes in your area have sold for and increase or decrease your asking price based on significant differences in size and amenities. You can also pay for a professional appraisal.
  • Removing any liens from the title: If a potential buyer discovers you have any liens on your home, this could kill a sale. You should preemptively review your title to ensure there are no mechanic's, construction or other liens against your house. If there are, you should work with an attorney to fight the validity of the lien or have it removed.
  • Hiring an agent or preparing For a Sale By Owner: By hiring a real estate agent, you have someone who can help you price and stage your home. They also market your home for you. It is their job to get potential buyers interested, hold open houses, and schedule private showings for more interested individuals. If you choose to list your home for sale yourself, you will have to take on these responsibilities.
  • Receiving, reviewing, and countering offers: Once your home is on the market, you will receive offers. These can contain a variety of prices, requests, and contingencies. It is up to you to review the offers with the help of an agent and experienced attorney to determine whether you should accept, decline, or counter.
  • Providing necessary disclosures: Under Illinois law, there are certain disclosures you must make to potential buyers about the condition of the home. These disclosures include but are not limited to flooding or water damage, termites, code violations, and environmental issues. An attorney can help you fill out this form and ensure you disclose only what you need to.
  • Preparing the final sale contract: Upon accepting an offer, you may need to present the final sales contract or review the contract prepared by the buyer. A contract for the sale of a residential home can be complex and will include a great deal of legal and financial jargon. Be sure to work with a real estate attorney to carefully review this contact. Generally, the contract will include an attorney review period, which will begin as of the date of acceptance.
  • Closing: As the seller, you have the option of whether or not to attend the closing ceremony. Frequently, sellers choose not to attend, in which case the closing documents must be signed in advance and arrangements will be made for handling your sale proceeds. If you prefer to attend closing with your BGL attorney, you should plan on blocking out at least two hours of your time that date.
