Police Officers Charged for Covering Up DUI Crash Two police officers in Los Angeles are in hot water after, according to prosecutors, they arrested someone they suspected of driving under the influence (DUI), but then drove him home instead of conducting an investigation.

Hit and Run Accident Leads to DUI Arrest

The incident occurred on the night of October 26, 2014, in the Hollenbeck Division's Boyle Heights area. Two officers responded to a call of a hit and run car accident. Someone driving a light colored Mustang had collided with a pair of other parked cars and tried to run. Residents in the area ran him down and tackled him, then waited for the police. They all noted that the driver was acting very drunk.

When the officers arrived on the scene, however, they arrested the driver, put him in their cruiser and, according to an internal investigation into the scenario, drove him home and told him to go to sleep. The officers then filed a false police report about the situation.

Officers Face Felony Charges

After the department conducted an internal investigation, both officers are facing potential felony charges that could lead to up to three years in jail. Their defense attorney, however, claims that they did nothing wrong and that they had followed standard police protocol for a hit and run case. They had even impounded the Mustang that was involved. He also noted the fact that it had taken prosecutors nearly two years to pursue charges, and that there was no clear connection between the officers and the driver they took home in their cruiser.

Police Officers Using Their Own Discretion is a Problem

Whenever police officers are allowed to use their discretion in how to investigate and respond to a crime, it becomes a problem. While, in this case, the two officers involved seemed to have decided to look the other way, all too often the police response is overly-harsh. While police will always have at least some discretion on how to act while they are on patrol, limiting this as much as possible will ensure that everyone is treated equally, so they know what to expect if they get pulled over and investigated for a crime.
