Obtaining Orders Of Protection In Illinois

In Illinois, you can obtain an emergency order of protection based solely on your testimony, and you can file for an emergency order at any time of the day or night. Depending on the circumstances, a judge can have the abuser removed from the home and may grant you possession of property that could be in jeopardy following the order. An emergency order will last 14-21 days until a full hearing can be convened.

At the full hearing, the accused (along with counsel) has the right and opportunity to present evidence in his or her defense. If the judge feels that a plenary order is justified, it can be granted for up to two years. (Though it may be renewed an unlimited number of times). If there is a gap in time between when the emergency order expires and the hearing is scheduled, you may obtain an interim order of protection for up to 30 days. The accused abuser must have been notified of the hearing, however.
