DUI Charges In Illinois

The state of Illinois takes driving under the influence very seriously and imposes stiff penalties for these offenses. The severity of the penalties depends on whether you have had previous DUI convictions. The Illinois DUI Factbook lists in detail all of the potential penalties for DUI convictions. For the first conviction, a Class A misdemeanor, you stand to lose your driving privileges for at least one year, up to a year in jail, and up to $2,500 in fines. For a second conviction, also a Class A misdemeanor, you risk losing your driving privileges for at least five years (if within 20 years of the first conviction), up to a year in jail and up to $2,500 in fines. Additionally, you will be sentenced to either a mandatory five day jail sentence or 240 hours of community service.

A third conviction for DUI is considered an aggravated DUI and a Class 2 felony. The penalty for a third conviction is loss of driving privileges for at least 10 years, possible prison time of three to seven years and up to $25,000 in fines.

All of the penalties for DUI convictions in Illinois can be amplified depending on the circumstances of the arrest. For example, if the offense is committed while transporting a child under the age of 16, if the BAC is .16 or more, or if there is an accident resulting in injuries, there are additional consequences.
